7th circuit appellate court:           Unless all parties consent to the civil litigation, the judge can do nothing but recommend.... the parties have not consented.....the court lacks jurisdiction.

My Response   in short the reality is: this is a known constitutional law case/ not a civil one.  Which means jurisdiction is mandatory, and the parties involved have no discretion to “consent” :   rather they are sworn to obey, by their own oath of office.
